		<description><![CDATA[ Hello all! Need some help here, I have a small collection company in Ohio, and we are small but growing quickly. We just switched direction and adapted to commercial collections and our client base has doubled in size. Can some here walk me through a good accounting system that would help keep track of clients in either Microsoft 2007 business accounting or Quick Books Pro? <BR><BR>My collection system that I have has collection front office but we would rather track this in accounting software as well. I did not expect business to pick up this quickly. <BR><BR>Can someone here again give pointers from point A to point B in the accounting side of collections? 		<description><![CDATA[ I have an account that owes my company 35k...he didnt pay and probably wont. I need to sue him with very little use of our attornies, is this even possible? This is in Nebraska..she told me that all I had to do was petition the court..cannot seem to find any such forms online. Can anybody steer me in the right direction? The 35k is for product..no contract disputes, fairly cut and dry..shipped a bunch of stuff..never paid...if I can do this all myself that would be more cost effective...thanks ]]></description>

		<description><![CDATA[ Hey Everyone, I have a question for you all and maybe you can share your answers with me.<BR>First, I want to start out by saying I am a mortgage broker with Premier Mortgage Funding.  I do primarily residential but 1-2 commercial deals a month.  Of those commercial deals, they are either purchases or business lines of credit up to $75k.  My question is this:  When collecting on past due debts from these businesses, do any of you ask if they have tried to refinance their business to pay you off?  I know it seems like a simple question, but I am looking to balance my office out by moving more towards commercial refinance and less on the residential side. 		<description><![CDATA[ I am a creditor that has a collection file for about $250,000 and have sent it to an attorney to collect because it has to be litigated.  The contract that the attorney has drawn up is that there is a 10% non-contigent suit fee, an 18% contingency fee and $1000 up front cost fee.  We will also be expected to cover any out-of-pocket expenses.<BR><BR>The collectibility of this debt is questionable.  Not sure if the debtor's company is solvent any longer or if they have assets to attach.  <BR><BR>I would rather do a contingency split - say 50/50 - pay the out-of-pocket expenses and in the event that we determine early on that there are no assets then abandon the collection.<BR><BR>I need the opinion of people who do commercial collections.  I normally do consumer debt.<BR><BR>Thanks ]]></description>

		<description><![CDATA[ We are a commercial agency in NY.  What is a good tool to locate assets once our attorneys have obtained judgment?  Most of our attys are coming back to us advising they can't find assets/bank accounts and that our judgment is uncollectible.  If I were my clients, and I had all of these uncollectible judgments - I wouldn't be a happy camper.  <BR><BR>What companies out there specialize in locating assets?   ]]></description>

		<description><![CDATA[ Hello old friends, <BR>I have a question. We have commercial accounts that we sometimes have to decline for credit, however we offer an option of the president signing a personal guarantee in which we then make our credit decision based on thier personal credit and their personal  assets. <BR><BR>The FDCPA's definitions of "consumers" and "debt" specifically restricts the coverage of the act to personal and non-commercial transactions. <BR><BR>With that being said, does the use of the personal guarantee blur the lines to the point that I now need to follow FDCPA on these accounts as a consumer debt? Im assuming it is no longer considered commercial. Maybe yes, maybe no.<BR><BR> ]]></description>
